GRUTA Terms of Use

Please read the following Terms of Use before using GRUTA.

These Terms of Use, together with the Privacy Policy , and the GRUTA Bonus Terms , constitute a binding agreement between you and Bloomberry Resorts and Hotels, Inc. (hereinafter referred to as "BRHI", "we," "us," or "our"), with respect to your use of GRUTA:

  1. You confirm and affirm that you are twenty-one (21) years old or above.
  2. We reserve the right to verify your age and the identity you provided through our Know Your Customer (KYC) procedures as required by the applicable Anti-Money Laundering (AML) regulations.
  3. Your grant to play games via https://GRUTA.BET (the GRUTA Website) and the GRUTA App is solely upon the discretion of BRHI, subject to existing laws and government regulations.
  4. Only one (1) player device may access your GRUTA account at any given time.
  5. You may only use your GRUTA account by logging into the GRUTA App or the GRUTA Website through your login credentials. You are solely responsible for maintaining the confidentiality and security of your GRUTA login credentials. You are not to disclose your login credentials to third parties under any circumstances. You must notify us immediately if you suspect any unauthorized access to your GRUTA account.
  6. To be eligible to play any of the pay to play games in GRUTA, you must have sufficient funds in your GRUTA Account Balance. All deposits and withdrawals in your GRUTA Account are subject to transaction monitoring and AML compliance checks, including source of funds verifications.
  7. Daily cash-out transactions are limited to a maximum aggregate amount of Five Hundred Thousand Pesos (PHP 500,000.00), within a 24-hour period (from 12:00:00 AM to 11:59:59 AM (Philippine Standard Time) of the next day). We reserve the right to review, limit, or suspend any and all transactions as may be necessary to comply with AML and other regulatory laws and requirements.
  8. If you are disconnected from the GRUTA Website or the GRUTA App after successfully placing your bet in any of the GRUTA games, the said game will proceed and any winnings or losses will be processed based on the outcome of the said game. Any winnings or losses, if any, would be automatically credited to or debited from your GRUTA Account Balance, as the case may be.

  10. BRHI will not be liable for any losses or damages resulting from misuse, unauthorized access, negligence, or third-party interference related to your GRUTA Account absent any direct fault or gross negligence on the part of BRHI.
  11. We reserve the right to cancel or change these Terms of Use.
  12. To maintain the integrity and security of all transactions, you will be required to complete a full verification process before initiating any withdrawals from the GRUTA Website or from the GRUTA App. This measure ensures compliance with regulatory standards and safeguards both for you and the platform.
  13. Your withdrawal requests will only be honored once you have completed the entire KYC process and passed all AML/compliance checks. Withdrawal requests will be processed in accordance with the timelines set out in the table below. The following table sets out (i) each supported payout channel, (ii) its corresponding timeframe, and (iii) the maximum amount per transaction:

    Note: *All transactions are subject to the daily cash out transaction limit of Five Hundred Thousand Pesos (PHP 500,000.00) as set forth in Clause 7 these terms.

  14. To uphold the integrity, security, and regulatory compliance of all financial transactions on our platform, the use of third-party payment methods is strictly prohibited. All deposits and withdrawals must be conducted exclusively through payment accounts (e.g., bank accounts, credit/debit cards, e-wallets) that are registered in the name of the verified account holder.

    A third-party payment method refers to any payment account or financial instrument not registered under the name of the verified platform user.

    The following are prohibited practices:

    1. Use of payment accounts that do not match the name of the verified user.
    2. Deposits or withdrawals made via third-party-owned bank accounts, e-wallets, or credit/debit cards.
    3. Sharing or pooling of funds between multiple users through a single payment method ("pasaload").

    Consequences and Enforcement

    1. Any transaction identified as originating from or intended for a third party may be cancelled, reversed, or frozen without prior notice.
    2. Repeated or deliberate violations may result in account suspension or permanent closure.
    3. Users may be required to submit proof of ownership of the payment method used. Failure to comply may result in transaction delays or account restrictions.

    By using our platform, users acknowledge and agree to abide by this policy as a condition of continued access and use.

  15. The laws of the Philippines govern all matters arising out of or relating to the use of GRUTA including without limitation, its validity, interpretation, construction, performance and enforcement of the Terms of Use herein.
  16. If any controversy, claim or dispute arises out of or in relation to these Terms of Use, including any breach, termination, enforcement, interpretation or validity thereof, the parties shall first attempt in good faith to amicably resolve the matter within thirty (30) days from a party's written notice to the other, specifying in the said notice the nature of the dispute. If the parties are unable to reach a settlement within the said thirty (30) day period, they agree that the dispute shall be submitted to exclusive jurisdiction of the proper courts of Parañaque City, Metro Manila, Philippines.
  17. We reserve the right to correct any erroneous or fraudulent deposits or payments applied to your GRUTA Account balance due to fraud, system or human error, overpayment, wrong payment, or mistake. In the event of any such erroneous payment, we may, at our sole discretion, debit the amount of the fraudulent payment, overpayment or mistaken payment from your GRUTA Account balance without prior notice. Should your account balance be insufficient to cover such adjustment, you expressly agree to reimburse us immediately upon demand.
  18. To the maximum extent permitted by applicable law, in no event shall we, our affiliates, officers, directors, employees or agents be liable to you or any third party for any indirect, incidental, special, consequential or punitive damages arising out of or relating to these Terms of Use or your use of the GRUTA App and/or the GRUTA Website. Our total aggregate liability for any claim arising out of or relating to these Terms of Use, and/or the use of the GRUTA App and/or the GRUTA Website shall only be for any actual damages/losses that may be incurred by you, directly resulting from our fault or negligence.
  19. You agree to indemnify, defend and hold BRHI harmless, its affiliates, officers, directors, employees and agents from and against any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys' fees) arising out of or related to:

    • your breach of these Terms of Use;
    • your violation of any law or the rights of a third party; or
    • your use of GRUTA other than as expressly authorized in these Terms of Use.
  20. We shall not be liable for any delay, interruption or failure in performance of our obligations under these Terms of Use, either in whole or in part, resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, fires, floods, civil unrest, war, national emergencies, strikes or labor disputes, pandemics, public health emergency, governmental actions or failures of telecommunications or internet service providers. Upon the occurrence of such an event, we may suspend or cancel the affected services without liability.
  21. All content, features, functions, materials, trademarks, service marks, logos and any other intellectual property provided in connection with GRUTA, including software code, graphics, text and audiovisual materials, are owned by us or our licensors. Subject to your compliance with these Terms of Use, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use GRUTA solely for your personal, non-commercial entertainment purposes.
  22. We reserve the right to suspend or terminate your access to GRUTA and to deactivate or delete your GRUTA Account without notice if we determine, in our sole discretion, that you have violated any of these Terms of Use, engaged in fraudulent or illegal activity, acted in a manner that could harm us or any third party, or jeopardize our license to operate our business. Upon suspension or termination of your GRUTA Account, your right to use GRUTA shall also immediately cease, and any funds in your Account Balance will be handled in accordance with applicable law and our internal policies.
  23. We may provide notices to you via email, in-app notifications, registered mail, private courier, or by posting on the GRUTA Website. All notices will be deemed given and effective upon transmission or posting. You agree to keep your contact information up to date and to promptly notify us of any changes thereof.
  24. Pursuant to the PAGCOR Charter and Malacañang Memorandum Circular No. 8, the following persons are not allowed to play at any gaming establishments, and thus may not also play any of the games of the GRUTA App and the GRUTA Website:

    • A Government Official connected directly with the operation of the Government or any of its agencies;
    • A member of the Armed Forces of the Philippines, including the Army, Navy, Air Force or the Philippine National Police; and
    • A person under 21 years of age or student of any school, college or university in the Philippines.

  26. You acknowledge and agree that, in addition to these Terms of Use, you have also read, understood, and agreed to be bound by the GRUTA Bonus Terms , which are incorporated here by reference. If you do not agree with the Bonus Terms, you must not accept these Terms of Use and you must not participate in any promotional offer or Bonus.
  27. These Terms of Use, together with the Privacy Policy, and the GRUTA Bonus Terms, constitute the entire agreement between you and BRHI regarding your use of the GRUTA App and the GRUTA Website, and supersede all prior or contemporaneous communications, proposals or agreements, whether oral or written. If any provision/s of these Terms of Use is held invalid or unenforceable by a court of competent jurisdiction, such provision shall be struck and the remaining provisions shall remain in full force and effect.
  28. In case of inconsistency/ies between the English and Filipino, Taglish or any other language version of these Terms of Use, the English version shall prevail.
